Model declaratory action decided – Austrians also included
Vienna (OTS) – The Stuttgart Higher Regional Court today determined in a model declaratory action that the model defendant’s Euro 6 vehicles at issue with the model names GLC 220 d 4Matic, GLC 250 d 4Matic (production period from June 1st, 2015 to November 30th, 2016) and GLK 220 Bluetec 4Matic and GLK 250 Bluetec 4Matic (each production period June 1, 2012 to May 31, 2015) at the time the vehicles were placed on the market contained an inadmissible shutdown device in the form of a so-called “Strategy A in a comparable form”.
This also applies to Euro 5 vehicles with the model names GLK 200 CDI, GLK 220 CDI and GLK 220 CDI 4Matic (each produced between 2012 and 2015).
„The Consumer Protection Association (VSV) has also joined a number of Austrian victims in the model declaratory action. They now also have a good chance of receiving compensation
“, says Daniela Holzinger, chairwoman of the VSV.
Mercedes has announced an appeal to the Federal Court of Justice. The Verdict is therefore not yet legally binding. If it persists, it would only discovered that Mercedes had installed illegal defeat devices. On performance of All participants must then sue for damages themselves.
„Our litigation financier will then support these vehicle owners and – in return for a success fee – finance these lawsuits for performance
,” announces Holzinger.
