The “Citizen Attorney”: Unnoticed Death | ORF, May 24, 2024

On May 25th at 5:55 p.m. on ORF 2

Vienna (OTS) Peter Resetarits deals with the following cases in the latest “Citizens’ Lawyer” issue on Saturday, May 25, 2024, at 5:55 p.m. on ORF 2:

No reforestation of important protective forest

The W. family owns a piece of forest in the Kleinwalsertal in Vorarlberg. The so-called protective forest is intended to protect against avalanches and mudslides. In the summer of 2020, the Bregenz avalanche control unit cleared the old trees from the forest. It was agreed with the family that reforestation should take place again by autumn 2022. But to date nothing has happened. The avalanche control agency insists that the W. family should make their private path to the forest available to hunters so that they can better regulate the game population. But the family doesn’t want that and states that there is nothing about it in the agreement. Ombudsman Walter Rosenkranz understands the family’s attitude.

Unnoticed death – Why weren’t the relatives informed of the uncle’s death?

The G. family from Vienna will meet for Christmas at the end of 2022. But one person is missing, Uncle Franz. Because he can’t be found at home either, the nephew calls the police. From there he learns that his uncle died nine days ago. Ombudsman Walter Rosenkranz last year called for a new set of rules to ensure that relatives are informed of deaths. What has happened since then?

Expensive apartment with many defects

A young couple bought an attic apartment with a terrace in Vienna for around 600,000 euros and complained to the “ Bürgeranwalt ” editorial team about serious structural and legal deficiencies. The seller and builder of the apartment repeatedly assured that he wanted to fix everything. But little or nothing happened, says the young couple. Many other home buyers in houses from this housing developer feel the same way. What chances do they have of getting their apartments legally and technically renovated?

Property restrictions in Tyrol – Why were the lands of three farmers declared a water protection area?

A drinking water fountain and an associated water protection zone in the municipality of Stumm in the Schwaz district in Tyrol have been causing a dispute between the local water cooperative and several farmers for years. The latter complain that the restrictions on the protection zone have de facto dispossessed them. They were originally told that the zone would only be intended as an emergency supply for a period of five years and that alternative water sources would be sought. Does this exist after a discussion in “Citizen’s Advocate”?
