LVwG Lower Austria: Hubmann free-range pig farm sentenced to high penalties today

Eviction notice not followed – judge pulls out all the stops to be able to sentence, even though there is a prospect of approval for the business and your own BOKU project

Vienna (OTS) The pigs “in the tent in the field” The Hubmann family has it much better than their counterparts in the surrounding fully slatted floor factories. And they do not pollute the groundwater either, as a separate report confirms. Nevertheless, the BH St. Pölten carried out criminal proceedings and issued an eviction order, which the Hubmanns did not follow. This was heard today at the Lower Austrian State Administrative Court in St. Pölten. Despite the fact that the two bodies of the BH water authority had neither contacted the Hubmanns during their inspections as witnesses today (“I don’t know why not, that would be normal”), nor could they say for sure where the pigs were because they were running the business had not entered at all, the judge imposed a total fine of €5,500. To do this, however, he had to rewrite the original penalty notice because the pigs were no longer on the site in question. The level of punishment was necessary for prevention, the judge explained when justifying the verdict, and also prohibited the ordinary appeal to the Administrative Court.

The prospect of approval for the operation is very good. The application should be submitted by April 4, 2024, supported by the BOKU and federal water law experts. If approved, BOKU’s four-year research project on this pig farming can be submitted by the end of June and started in the fall with a capital of €400,000. If the Hubmanns had followed the eviction order, for which they were punished today, there would be neither a permit nor this research project.

VGT chairman DDr. Martin Balluch was there today as a trial observer: “At the original trial date, the authorities and the witnesses from the water authority were unapologetic did not show up. The judge tolerated this. The penalty notice referred to a different property than the one on which the pigs were located, but the judge simply changed the notice instead of identifying a formal error that should have led to the proceedings being discontinued. The witnesses were unable to provide any precise information and did not contact the Hubmanns during the inspection, which would have been normal. The checks took place from the public street, from where pigs could only be heard but not seen. The water rights report on the operation was ignored. And the judge imposes a very high sentence for special and general prevention, even though the Hubmanns are not only blameless, but also pioneers of pig farming in a direction that society demands. What tricks were necessary to put these brave people under such pressure! We at VGT will continue to support them. This process stinks to high heaven – in contrast to Hubmann’s pig farming!
