Jollydays GmbH went bankrupt on August 17, 2024. The company specialized in providing experiential activities. It sold vouchers for thousands of different experiences. These were redeemed by the respective experience provider after booking on the Jollydays website. Anyone who is still sitting on Jollydays vouchers can register their claims in bankruptcy proceedings. The liquidator decides whether the company will be continued.
In July, the first consumers complained that Jollydays vouchers had not been redeemed. For example, a sightseeing flight, a boat trip, a romantic dinner or a trip in a Maserati did not take place because the respective provider refused to redeem the voucher. According to consumers, the providers did this because they had not received any money from Jollydays for months. The AK consumer advocates wrote to Jollydays GmbH, but the letters remained unanswered.
What are the consequences of declaring bankruptcy?
The bankruptcy court appoints a lawyer as administrator. This person has to decide what happens next with the company. During the bankruptcy proceedings, individual creditors may not be given preferential treatment or disadvantage. The redemption of individual vouchers is therefore no longer possible. All information about the bankruptcy procedure is published in the bankruptcy file.
What can voucher holders do after bankruptcy?
The purchase contract for the voucher is with Jollydays GmbH. The respective experience provider is therefore not obliged to redeem the voucher. Voucher holders can register their claim in bankruptcy proceedings until October 10, 2024. A fee of 25 euros must be paid for this. However, it depends on the amount of the claim and the outcome of the bankruptcy proceedings as to whether these costs can even be recouped with the bankruptcy rate.
