The so-called “Petuely era” is a dark and so far barely illuminated chapter in Austrian judicial history. Over a period of almost 20 years, an official was able to achieve a position of power that was hardly limited under the pretext of “consumer protection”: Starting from his function as a food inspector, he increasingly influenced legislation and enforcement and, in particular, the court proceedings in criminal food matters.

About the author:
Dr. Christian Hauer, lawyer emeritus, who worked for the Schönherr law firm for almost 50 years and as an equity partner since 1975, particularly in the areas of UWG and intellectual property, specialized in food law during the “hot” phase of the “Petuely era”. and from 1975 to 1983 represented him as a criminal defense attorney in around 1,200 trials in food-related criminal cases. His decision to document the incidents that occurred over 40 years ago was significantly influenced by the current discussions about the danger of the judiciary being taken over by politics.
