In a ruling from the Klagenfurt Regional Court reached by the consumer protection association VSV together with trusted lawyer Mag. Salburg, it was legally established that the increase in the basic price by Energie Klagenfurt GmbH regarding electricity supply contracts from EUR 1.44/month to EUR 4.90 as of April 1, 2022 /month was legally inadmissible.
“As VSV, we have asked Energie Klagenfurt GmbH to refund the amount wrongly collected to the affected customers and to undertake in the future to refrain from unilaterally increasing the basic price of electricity supply contracts without complying with the provisions of Section 80 Para. 2a ElWOG must be complied with.”
said the chairwoman of the VSV, Daniela Holzinger.
If Energie Klagenfurt GmbH refuses to reimburse customers for the unlawful additional costs, then VSV – in its new role according to the QEG – will take legal steps to stop the statute of limitations of the claims in the interests of the over 50,000 affected customers.
“It may be a relatively small claim at just under EUR 42.00 per connection, but multiplied by the high number of electricity supply connections, Energie Klagenfurt GmbH’s unfair profit runs into the millions. Money that needs to be paid back to the people because it was collected unlawfully.”
