The hunters didn’t like that, and so in return for the ban on gate hunting in 2017, Section 100 (3) was added to the Hunting Act, apparently in order to appease the hunting side, which allows a BH to temporarily close public roads “for safety reasons” via the road traffic regulations StVO these border on a driven hunting area. However, the StVO does not provide for such closures due to animal protection cameras. But that is definitely the goal of the large-scale exclusion zones that are issued by the Neusiedl am See BH for 21 days every year in order to prevent the documentation of the hunts for hares and pheasants around Gattendorf.

On November 19, 2023, a VGT employee entered a public street that was in a restricted zone with a camera in order to… driven hunt on hares and pheasants. He has now received a sentence, which has now been appealed by the VGT.

VGT chairman DDr. Martin Balluch has often documented driven hunts from public streets: “It is of course legally covered to document the events of such driven hunts in the interest of the public, in which hundreds of hares and pheasants are massacred in the most cruel way. There are no legal provisions for exclusion zones to exclude cameras. The BH claims to have enacted these exclusion zones to protect the population. However, the post office, a tiling company, residents and a cyclist were allowed to use these closed streets unhindered; only animal rights activists with cameras were reported. Apart from that, the exclusion zones extend into populated streets and even residential areas because from there you can still see the battue hunting area. However, according to Section 97 of the Burgenland Hunting Act, it is forbidden to hunt near residential areas. This action by the BH is clearly illegal and that is why we are now taking this case to the State Administrative Court.
