Carpenter wrongly dismissed: AK won almost 44,000 euros in severance pay and termination compensation

Linz (OTS) Because he wanted to save himself the severance pay, the boss of a carpentry business in the Linz-Land district invented a flimsy reason for an immediate dismissal. The fact that the entrepreneur didn’t get away with this scam was thanks to the efforts of the AK. She went to the labor and social court on behalf of the innocent carpenter. There the employee was awarded all claims. He received almost 44,000 euros in back pay.

After 35 years in the company, a carpenter from the Linz-Land district was laid off. On the one hand, that was painful, but on the other hand, he was at least entitled to severance pay and all termination rights. Shortly before the end of the notice period, the employer obviously became aware of this. And he wasn’t too stupid to accuse the long-time employee of theft and dismiss him without notice. This would mean that the carpenter would have lost all of his claims.

He turned to the Chamber of Labor for help. Since he hadn’t stolen anything or done anything else wrong, the AK took action on his behalf. In an intervention to the company, it was pointed out that the dismissal was illegal and it was made clear that the employer still owes the former employee all sorts of payments: severance pay in the amount of twelve months’ salary, outstanding wages, special payments that have not yet been paid, vacation compensation for unused vacation as well as compensation for dismissal for the period between the unfair dismissal and the notice period.

The letter did not lead to any insight from the company. In such cases, the AK denies legal action. So she filed a lawsuit with the responsible labor and social court. This investigated the allegations and viewed evidence that the employer had submitted. Ultimately, the court concluded that the allegations were unfounded and the dismissal was wrongful.

The carpenter was thus acquitted of the absurd accusation of theft and received payment of his unpaid labor claims, totaling almost 44,000 euros.
