Fake news banned by the court: Fiakers win again against alleged animal rights activists

Association against animal factories loses again at the highest court. False claims are not permitted. Animal welfare is the economic basis of the Viennese Fiaker.

Vienna (OTS/LCG) In its final judgment of April 16, 2024 (6 Ob 39/24j), the Supreme Court confirmed the judgment of the Vienna Commercial Court (1 R 143/23k) as the responsible appeal court of September 20, 2023. The Association Against Animal Factories distributed one in the past Folders also available on the website with alleged “fiaker facts” that are not true. Among other things, it talks about accidents with fatal injuries to people. Such accidents have not occurred in Vienna in the last two decades. The defamatory claim is directed against the horse-drawn carriage companies in the federal capital and is damaging to business. Likewise, it is not permissible to claim that horses would collapse or become emaciated due to heat. The Association Against Animal Factories has been trying for years to damage the image of local horse-drawn carriage companies and deliberately spread false information that has no basis.

“Animal protection is our top priority as the largest horse-drawn carriage company in Vienna and the largest carriage company in the world. We live and work with and for our animals, whose well-being is the basis of our profession. The association’s targeted false allegations against animal factories have the sole aim of damaging a traditional industry that is deeply anchored in the Viennese soul and ruining our public reputation. We won’t put up with this anymore. We simply want to live in peace with our horses and give people special experiences. If this is constantly being sabotaged, then you have to defend yourself like this.”summarizes Marco Pollandt (Fiaker Paul) together.

Fiaker Paul, Vienna’s largest fiaker company, was represented in the legal dispute against the association against animal factories by the law firm Rast & Musliu, which successfully took action against the false claims of the self-proclaimed animal rights activists last year. Even back then, the veterinary office’s expert opinion was convincing that most horse-drawn carriage companies voluntarily exceed the strict rules of the Animal Husbandry Ordinance and, for example, offer their horses more exercise, exercise and space than is legally required.

However, the close controls by the authorities show that the horses in our city are doing very well. The Supreme Court’s ruling is an important signal against intentionally spreading fake news.”emphasizes lawyer Nikolaus Rast.

The welfare of the horses

At the family-run company Fiaker Paul, great importance has always been placed on the well-being of the horses, which are treated as family members. They are only on duty four days a week.
