If you want to exchange your gift because the size of the jacket doesn’t fit, you need the invoice. You only have the right to an exchange when purchasing online. + No right to exchange: There is no legal right to exchange in brick-and-mortar stores. An exchange is only possible if the dealer voluntarily grants this – this is usually stated in the general terms and conditions (GTC) or on the invoice.

+ Online purchase – 14 day exchange: When purchasing online, you generally have a 14-day right of withdrawal. Exceptions: such as personalized mugs or concert tickets. If you are not properly informed about your right of withdrawal, the deadline will be extended by twelve months. Attention, extended return periods until well after X-Mas are not regulated by law and are voluntary! However, if they were agreed upon at the time of purchase, they are binding.

+ Redeem vouchers soon: Vouchers are generally valid for up to 30 years. A shortening of the deadline is possible – but only if the entrepreneur has a good reason for it. Vouchers should be redeemed as quickly as possible. Because if the provider goes bankrupt, vouchers are usually worthless in the insolvency proceedings. You can register your claims, but given the low quotas and court costs of 25 euros, this is only worthwhile if the claims are very high.

+ Gift with defects – warranty applies: If the gift has a defect, there is a legal right to a warranty. Assuming the defect was already there at the time of purchase. Retailers must repair or replace the goods free of charge up to two years after purchase. If this is not possible, you can claim a price reduction or demand your money back. Your dealer (not the manufacturer) is responsible. There are no formal requirements, but for documentation purposes you should report defects in writing and by registered mail.
