Wien (OTS/LCG) – Eventim Austria, Austria’s largest e-commerce company, leading partner of the culture and events industry in sales and operator of the market-leading platform oeticket.com, achieved a significant victory before the Supreme Court (OGH). In the final decision (9Ob34/24a) of May 28, 2024, two clauses from the general terms and conditions and the ordering process, which provide for a service fee for ordering tickets, were declared admissible.
The OGH specifies: “Service fee from ticket agent permissible. The clauses are transparent because the customer receives information about the specific amount of the service fee as part of the online ordering process immediately before placing the order. They are also not grossly disadvantageous because the case-specific service fee – unlike cases of other ‘service fees’ – is not an additional fee that restricts, changes or undermines one’s own service promise. Rather, a total price is agreed here, which already includes the service fee and is specifically stated before the order is placed.”
